MAYHEM MC BYLAWS

I. MISSION STATEMENT
1.01 Mission Statement

The Mayhem MC is a family oriented Motorcycle Club that is dedicated to the support of our brothers and the belief in the freedom of the road. Mayhem MC believes in bridging the gaps between civilians and motorcycle clubs, for the establishment of a family oriented club. The strength of the Mayhem MC relies on the trinity of Loyalty, Bravery and Honor as is exhibited by its Membership.

 

II. CREATION AND OWNERSHIP
2.01 Creation and Ownership

The Mayhem Motorcycle Club was created through the united respect, ideals, beliefs and mutual sense of family, by the founding Member

This founding Member hereafter reserve all rights to the control and design of the Mayhem Club colors, name, copyright, state mark, and federal trademark. The founding Member has exclusive control of the Mother Club. The founding Member will always maintain ownership of the Mayhem MC, to ensure the Club is lead in the path set forth by their vision.
Chris Johnson founder of Mayhem MC shall forever be president of the Mother chapter.and shall never be put out of the Mayhem mc for any reason whatsoever!
also the founder does not pay dues ever.


III. HISTORY OF CLUB NAME

3.01 History of Club Name

The history and meaning behind the Name of the Mayhem MC is as follows:

the name Mayhem was derived from the Mayhem metal Music Festival at darien lake in 2008.
Mayhem is not always a negative thing,lets show it's positive side!


IV. RANK STRUCTURE
4.01 Boards and Chapters
(A) International Executive Board
The International Executive Board will consist of the Founding Member of the Mayhem MC during the first years of the Club’s life; thereafter, the International Executive Board will consist of elected Full Patch Members, The International Executive Board will consist of a President, a Vice President, a Secretary/Treasurer, and any other positions and/or committees that are elected by the International E-Board. The International Executive Board will oversee the Club-wide observation of the by-laws, communication of Club business to Nomads, and the fair and just handling of Club issues (including, but not limited to, the voting and vetting in of new Chapters and Nomads, modification of the Bylaws, Codes of Conduct, and other Club documents, complete records of Membership information and Club history, the organization of Club-wide events, any punitive measures distributed from the Presidents’ Roundtable to a Chapter or Member, and all other Club-wide votes and decisions).

(B) Chapters
Chapters will be created in states with a minimum of at least 5 Full Patched Members. Each Chapter will likewise elect an Executive Board. The Chapter Executive Board will consist of the Founding Members of the Chapter during the first years of the Chapter’s life; thereafter, the Chapter Executive Board will be voted upon by the Chapter’s Membership every 2 years. The Chapter Executive Board consists of a President, a Vice President, a Secretary/Treasurer, and any other positions and/or committees that are elected by the Chapter E-Board. The Chapter Executive Board will oversee the Chapter observation of the by-laws, communication of Club business to the Chapter’s Members, and the fair and just handling of Chapter issues (including, but not limited to, the voting in of new Members and Associates, modification of the Chapter Operating Policy and other Club documents, the organization of Chapter events, any punitive measures distributed from the Chapter to a Member, Associate, or Prospect, and all other Chapter votes and decisions).

(C) Presidents’ Roundtable
The President’s Roundtable consists of the International President and all Chapter Presidents. Each President is responsible for protecting his Chapter’s interest during Roundtable votes and discussions. The International President and each Chapter President may cast one (1) vote during Roundtable decisions; that vote should represent the majority vote of the Chapter’s Membership. No Club-wide decisions shall be made until a majority vote has been reached by the President’s Roundtable.

 

4.02 Membership Positions
(A) International President
The International President is Chief Executive Officer of the Mayhem MC International (ie. chairman of the Executive Board, which consists of International President, Vice President, Secretary/Treasurer, Master-at-Arms, Commanding Officer, Chief Intelligence Officer and any other position elected by the International E-Board). The International President is responsible for the development, design, operation, and improvement of the systems that create and deliver the Club's mission and Colors, thus he has power and authority to run the Club’s administrative branch as he deems necessary for the good of the organization; for decisions that affect the entirety of the Club’s membership, the International President shall call a vote at the Presidents’ Roundtable. The International President is elected by a majority vote of all Chapter Presidents, and shall hold a 4 year term. The International cabinet, including International Vice President, Secretary/Treasurer, Master-at-Arms, Commanding Officer, Chief Intelligence Officer, and any other position voted into the Rank Structure by the International E-Board shall be appointed by the International President. This office must be held by a Member in good standing for a minimum of five (5) years.


(B) International Vice President
The International Vice President shall perform all duties and exercise all powers of the International President when the International President is absent or otherwise unable to act. The International Vice President is responsible for daily operation of the Club, and routinely reports back to the International President. The International VP is responsible for ensuring that Club operations are efficient and effective, and that the proper management of resources and human resources, distribution of funds and merchandise, management of the Club name and image, and analysis of queue systems is conducted. The International VP shall be responsible for developing and cascading the Club's mission statement to all Members, and implementing rewards/recognition and coaching/corrective practices to align Members with Mayhem MC goals. The International VP's duties include: planning by prioritizing charity, Member and Club requirements; maintaining and monitoring Membership expectations and motivation to fulfill Club requirements; and driving performance measures for Club operation (including a consideration of efficiency versus effectiveness), often in the form of reports convenient for review by Executive, State, and Chapter Boards.


(C) International Secretary
The International Secretary is responsible for the overall representation of the Mayhem MC, including all materials, media, and branding associated with the Club. As such, the International Secretary is responsible for the design, vision, and direction of the Club mission, thus he must have a strong command of the technical aspects of the Club. The International Secretary ensures that all branding, advertising, and media exposure is aligned with the values and image promoted by the Mayhem MC, and is therefore responsible for the management of Club records and public relations. International Secretary duties include: annual review of Constitution & Bylaws, Codes of Conduct, and other Club documents, management of Club records and correspondences, any and all copyright requirements, and any other duties deemed necessary by the International President/Vice President. The International Secretary routinely reports back to the International Vice President.


(D) Commanding Officer
The Commanding Officer has authority over the Nomads, and has freedom to run the Nomad unit as he sees fit, within the bounds of law. The Commanding Officer's responsibilities include: use of funds and equipment allocated to the Nomad unit, and frequent correspondences with Nomads and the International E-Board. The Commanding Officer's duties include: mission effectiveness, enforcement of respect for the Club Name and Colors, and duty of care to Club Membership (particularly Nomads). The Commanding Officer's power includes the ability to take disciplinary action against a Nomad requiring such action (per majority vote of the President’s Roundtable), as well as the ability to implement rewards/recognition strategies for the Nomad as he sees fit.


(E) Nomad
A Nomad has authority to enforce Club Bylaws and Codes of Conduct. A Nomad's responsibility is to ensure the safety of Mayhem MC Members and property, and to see that the integrity of the Mayhem MC name has been upheld. Though a Nomad has the right to be hosted by any Mayhem MC Chapter, he cannot direct a Chapter. Nomads act on instructions of the Commanding Officer, and report to the Commanding Officer regularly.

 

 

(H) Chapter President
The Chapter President shall supervise the affairs of his Chapter, including but not limited to: charity and fundraising events, social gatherings, Chapter meetings, and management of funds. The Chapter President shall preside over all Chapter meetings and events, and he shall conduct them with efficiency and dignity. The Chapter President shall grant voice to all Members present, and shall consider all information before making decisions on behalf of the Chapter. Other duties may include: co-signing checks on behalf of the Chapter, receiving and allocating charitable funds, calling special meetings or holding special votes. The Chapter President position shall hold term for a minimum of 2 years, and shall be decided by majority vote (51%) of the Chapter Membership. Candidates for Chapter Presidency must be a Member in good standing for a minimum of 1 year.


(I) Chapter Vice President
The Chapter Vice President shall be appointed by the Chapter President, and must be a Member in good standing for a minimum of one (1) year. The Chapter Vice President shall perform all duties and exercise all powers of the Chapter President if the Chapter President is absent or is otherwise unable to act. The Chapter VP, together with the Chapter President, shall oversee the operation of his Chapter and ensure that the integrity of the Club name is upheld. The Chapter VP is responsible for communicating the mission of the Mayhem MC to Chapter Members, and implementing rewards/recognition and coaching/corrective strategies where he deems necessary.


(J) Chapter Secretary/Treasurer
The Chapter Secretary/Treasurer shall have charge and custody of all funds of the Mayhem MC Chapter. The Secretary/Treasurer shall deposit such funds as is required into the Chapters' designated banking facility, and shall maintain adequate and correct accounts of the Mayhem MC properties and business transactions, including but not limited to: banking documents, receipts, and any other transactions approved by the Chapter President and Chapter VP. The Secretary/Treasurer shall keep an accurate record of Member status to include applications, background checks, current licensing and insurance, addresses and contact information. The Secretary/Treasurer shall keep minutes of all meetings, and shall maintain correspondences pertaining to Mayhem MC events and functions. The Secretary/Treasurer shall notify all Members of scheduled meetings, and shall notify the Chapter Board of any and all moneys owed to or by the Mayhem MC. The Chapter Secretary/Treasurer shall be appointed by the Chapter President, and shall be held by one individual or split between two individuals.


(K) Sergeant-at-Arms
The Sergeant-at-Arms is the enforcer of the Mayhem MC Chapter, and shall be appointed by majority vote of (51%) of Chapter Members. Duties of the Sergeant- at-Arms include, but are not limited to, maintaining order at Chapter meetings, gatherings and events. The Sergeant-at-Arms shall notify the Chapter President and/or Chapter VP of any and all activities that may be detrimental to the integrity of the Mayhem MC name, and/or the protection of Mayhem MC Members’ life and properties. The Sergeant-at-Arms position shall be voted upon every 2 years. sergeant-at-arms is also personal body guard to the president.

(L) Road Captain
The Road Captain shall be responsible for directing the movements of the Chapter while traveling together in a safe and lawful manner. The Road Captain shall assist in setting routes for upcoming events and/or rides, and he shall be responsible for keeping that route in the event of detours or road hazards. The Road Captain shall consider time restrictions, rest stops, meals and other meetings when setting a route, and shall inform the Secretary/Treasurer of the proposed trip so that Club moneys may be accounted for. The Road Captain is responsible for the safety of the rider, thus he is expected to take a safety survey of all bikes before a ride to eliminate any noticeable safety issues. The Road Captain is expected to work with other Road Captains to promote efficiency of the ride and maintain tightness of formation. There is no term limit for the Road Captain position, and will be considered ongoing unless voted otherwise by majority vote (51%) of all current full Members of the Chapter. It is at the discretion of each Chapter as to how many Road Captains shall be appointed.


(M) Optional Positions
Chapter may elect to create optional positions not stated herein (including, but not limited to: Tailgunner, Chaplain, Support Vehicle Driver, etc.) as the need for such positions arise.

 

V. MEMBERSHIP REQUIREMENTS
5.01 Consideration for Membership
To be considered for Membership in the Mayhem MC, one must adhere to the following protocols:


(A) Membership Application
Sign and complete the Mayhem MC Membership Application, indicating an agreement to abide by and maintain the integrity of the Mayhem MC By-laws


(B) Non-Compete Clause
Sign and complete the Non-Compete Clause, indicating an agreement to not pursue a similar Club (by Name, Patch Design, Colors or Trademark) or use any Club documents in competition or against Mayhem MC. Applicant will also be subject to a standard background investigation that will indicate any former criminal activity and/or issues regarding the character of the applicant which may hinder the good name of the Mayhem MC.


(C) Background Checks
Each Member will also be subject to periodic background checks to ensure the character of the Member and the sanctity of the good name of the Mayhem MC.


(D) Responsibility
Be responsible for the proper conduct and licensing of any and all fundraisers, raffles, or events that raise monies for Chapter business and/or charities, and to do so in accordance with local, state, and federal laws.


5.02 Open Membership
Membership of the Mayhem MC is open to any individual who exhibits dedication to the Mayhem MC moral code of loyalty, bravery, and honor.


5.03 Motorcycle Requirements
All Mayhem MC Members, including Prospect Members, must own and operate a motorcycle of 600cc or above. Members must possess a valid motorcycle operator’s license or permit, along with current motorcycle insurance.


5.04 Payment of monthly and yearly fees
Each new Member Application shall be submitted in hard-copy to the secretary . Hard-copy applications must be accompanied by a photo ID, proof of insurance, motorcycle registration and motorcycle operator’s license, as well as a payment for a monthly membership fee of $45 and yearly fee of $65 this fee shall occur as soon as person has been accepted as a prospect.

 


5.06 Conflicts of Interest
Mayhem MC Members are prohibited from being a Member of any other Motorcycle Club and will be required to wear Mayhem MC colors at any organized event at which the Mayhem MC is being represented.


5.07 Full Disclosure
Mayhem mc requires full disclosure of its Members; therefore, if a Member finds himself (or herself) in legal or moral trouble that might jeopardize the name of the Mayhem mc, that Member is expected to notify his/her President immediately. That President shall construct a plan to deal with the issue.


5.08 Mandatory Prospect Period
All Members of the Mayhem MC will observe a mandatory Prospect period of 3 months.

 

VI. PROSPECT MEMBERSHIP
6.01 Sponsorship & Induction
An individual who desires Membership with the Mayhem MC shall have a Full Patched Member in good standing as a sponsor. The sponsor must have personal knowledge of the Prospect Member. The sponsoring Member shall introduce the Prospect to the Chapter within the setting of a scheduled meeting. The Executive Board shall have the opportunity to question the candidates’ qualifications, knowledge of the Club’s mission and philosophy, and reasons for joining the Club. The Prospect Member shall then be dismissed from the meeting, and attending Chapter Members shall discuss that Prospect’s Prospect status. Induction as a Prospect shall be based on majority vote. The Prospect shall wear designated Prospect Colors until voted into the Club by majority vote as a Full Patched Member.


6.02 Voting Privileges
Prospect Members do not have voting privileges in the Mayhem MC.


6.03 Task Responsibility
Prospect Members shall be responsible for any lawful task assigned by their sponsors, provided that task has been approved by the Chapter President/Vice-President.


6.04 Riding Name
Prospect Members may submit a riding name for approval by the Chapter President. A riding name may also be assigned by that Prospect’s sponsor.
providing the prospect does not already have a riding name.


6.05 Prospect Period
The Prospect period is set at a maximum of 12 months and a minimum of 3 months. Once the Prospect has proven he or she is worthy of becoming a Full Patch Member, his sponsor and/or any other Full Patched Member will motion for a vote at a scheduled meeting.

 

VII. ASSOCIATE MEMBERSHIP
7.01 Spouses, Children, and other Family
Spouses, children, and family members of Full Patched Members shall be considered Associates, and shall be permitted to wear the Mayhem MC “Associate” patch on the back of a vest.


7.02 Full Member Responsibility
Full Members are responsible for their Associate, and shall be held responsible for any misuse of or damage to the Mayhem MC colors, as well as any slander or degradation of the
Mayhem MC name.


7.03 Suspension & Termination
Associates are subject to the same suspension and termination procedures as are full Members according to the Mayhem MC Constitution and By-laws.


7.04 Attendance at Events
Associates may attend any Mayhem MC event or activity, and will be expected to adhere to the Codes of Conduct of the Mayhem MC, and will maintain the integrity of the Mayhem MC name.


7.05 Hang around Eligibility
A Hang around who has contributed significantly, and who continues to support the Mayhem MC on a consistent basis, may be eligible for Associate Membership if accepted and voted in by the majority of the Mayhem MC Chapter’s Full Patch Members.


7.06 Widows of Fallen Members
The widow of a fallen Member may maintain her Associate Membership indefinitely, if she had been inducted into the brotherhood prior to losing her Member. If she had not been inducted into the brotherhood prior to losing her Member, the widow of a fallen Member may be inducted into the Associates by majority vote of the Chapter and its Associates. If the Chapter sees fit, a vote may be held to induct the Member’s widow into the Club as an Honorary Full Patch Member.

 

VIII. NOMAD MEMBERSHIP
8.01 Distance Requirements
Mayhem MC Nomad is a representative of the Mayhem MC International Executive Board. The Nomad resides at least one hour’s ride from the nearest Chapter.


8.02 Ambassadors of Goodwill
Nomads are first and foremost ambassadors of goodwill on behalf of the Mayhem MC. Nomads represent the Mayhem MC in their region, and seek to support brother Clubs, charitable endeavors, and Members or Chapters who are traveling or who may be in need of assistance from the International E-Board. A Nomad’s first priority is to communicate a message of positivity, uniting Chapters with the International E-Board so that unity, transparency, and brotherhood might be established.


8.03 Security Force
Nomads are also known as the “Security Force” of the Club, and will act on orders generated by the Commanding Officer, as long as those orders have first been approved by the International E-Board and/or the President’s Roundtable. The Nomad is the ears of the Mayhem MC and has a unique ability to record (in detail) any threats to himself or threats to the Mayhem MC, reporting back to the Mayhem MC Commanding Officer and/or nearest Chapter Executive Officer if directed to do so. The Nomad may be asked to travel to Mayhem MC Chapter meetings.


8.04 Self Preservation
The Nomad accepts and embraces the responsibility of holding him or a higher standard, despite the lack of constant interaction of other Mayhem MC Members. The Nomad shall be a self preservationist, taking his riding safety seriously, and flying his Colors only when he knows that he has the physical and mental ability to counteract any threats that might arise.


8.05 Attachments to Chapters
If a Member is not able to defend himself or herself from threats, then an exception shall be made and this Member will be attached to the nearest Mayhem MC Chapter, regardless of the residential distance. This Member may have restrictions on how and when to fly the Mayhem MC Colors, per the safety instructions of that Chapter’s Sergeant at Arms. These restrictions shall be agreed upon by the Commanding Officer and the International Executive Board.


8.06 First Contact
The Nomad is a “first contact” representative of the Mayhem MC International Executive Board and shall always show pride when discussing the Mayhem MC. The Nomad shall (using his best judgment, within the bounds of the law, the Bylaws, and the Codes of Conduct) put an end to degrading or defacing of the Mayhem MC Members, Chapter, or International Executive Board.


8.07 Bylaws and Codes of Conduct
The Nomads will follow all Mayhem MC By-Laws and Codes of Conduct. Nomads will answer directly to the Commanding Officer if evidence is ever found that said Nomad is representing the Mayhem MC in a negative light. Any actions taken against a Nomad will come directly from the Commanding Officer.

XI. CLUB MONIES
11.01 Application Fee & International Dues
Prospect members shall pay the same fee as a member of $45 per month and a $65 yearly fee to Mayhem MC

 


11.02 Chapter Accounts
Membership dues shall be paid to each Chapter in accordance with that Chapter’s Operating Policy. Each Chapter is responsible for creating a bank account to hold dues and other Chapter monies. All Chapter Executive Board members should be listed as co-signers on the account. Each Chapter shall draft up a legally binding agreement signed by all co-signers regarding the proper handling of Club Funds, which will clearly articulate: who can withdraw money, use a debit card, or sign checks on the account, and how much money can be spent without a Chapter vote. If the Chapter should fold, all Chapter debts shall be paid from the Chapter’s funds first, and the remaining balance shall be given to a charity chosen by the President’s Roundtable.


11.03 Non-Refundable Dues & Fees
All Membership dues and fees are non-refundable.

 

XII. PARTICIPATION & CLUB DECISIONS

12.01 Meeting Times & Locations
Each Chapter shall designate meeting times and locations. Each Chapter is required to meet at least once every 30 days. Each Member is expected to attend at least monthly scheduled Churches, and assist in at least two Mayhem MC events per calendar year. Special exceptions can be made to this rule if the Chapter President/Vice-President deems it necessary.


12.02 All Votes at Chapter Churches
All votes will take place at Chapter Church. No Chapter decisions will be made unless a majority vote can be reached. An absentee vote shall be allowed by a Full Patch Member if that absentee Member forwards his vote to the President/Vice-President prior to the meeting.


12.03 Day-to-Day Decisions
Club decisions pertaining to the day to day operation of the Mayhem MC can be made by the President/Vice-President between scheduled meetings. The President/Vice-President may use his discretion to make decisions for the betterment of the Club. However, no decision requiring the use of Mayhem MC monies (over $200) shall be made without a proper vote at a designated Church.


12.04 Visibility of Voting Issues
Voting issues may or may not be declared prior to a particular meeting. Therefore, if it is decided by those in attendance that the vote should not be held until all Members have had the right to vote, the issue shall be tabled until the following Chapter church. If it is decided by those in attendance that the item up for vote does not require the input of every Chapter Member, the vote shall proceed.


12.05 International Board Attendance
Members of the International Executive Board may attend any Church meeting held by any Chapter. The Chapter President of the Chapter holding Church will always preside over that Chapter Church, even if the International Executive Board President is present.

 

XIII. CLUB IMAGE
13.01 Formal Agreements
The Mayhem MC has entered into agreements with certain fulfillment companies with respect to the management of Club image and merchandising. For this reason, no Mayhem MC Club Member may reproduce the Mayhem MC image on any clothing, apparel, accessories, or web media without express written permission of the Mayhem MC International Executive Board. All purchases of merchandise or graphic representation of the Mayhem MC colors must be made with the Mayhem MC. fulfillment agreements will be in effect until a new formal agreement is reached by the Mayhem MC.


13.02 Purchasing Colors
All purchases of Mayhem MC colors, merchandise, or other materials must be made through the Mayhem MC International Executive Board. The Mayhem MC image may, however, be reproduced on fliers and/or stationary at the discretion of the individual Mayhem MC Chapters (with the direct and specific permission from the Chapter President). The Mayhem MC has the right to cease any Chapter’s colors reproduction for any reason at any time.


13.03 Non-Partisan Representation
The Mayhem MC is a non-partisan entity, and does not promote political activism of any kind. As such, the Mayhem MC colors must never be represented at political rallies, campaign activities, demonstrations, or any other event meant to promote a political agenda. The Mayhem MC name must never be associated with a Member’s personal political beliefs.

 

XIV. LEAVING THE CLUB
14.01 Member Resignation
If a Full Patched Member leaves the Club for any reason, he must submit his resignation in writing to the appropriate leadership. Upon the Member’s resignation, his Associate must leave the Club with him. If the Associate would like to remain a part of the Club after her Member has left the Club, she may make an appeal to the Club’s leadership (first to the Chapter Leadership, and then to the International Executive Board, only if she is unsatisfied with the results of her appeal to the Chapter Leadership). Such appeals will be handled on a case-by-case basis


14.02 Associate Resignation
If an Associate wishes to leave the Club, she may do so for any reason and without risk to the Membership status of the Full Patched Member to whom she is associated. An Associate’s resignation must be submitted in writing to the Club’s leadership via a Full Patched Member.


14.03 Divorce, Separation, or Parting of Ways
In the event of divorce, separation, or another parting of ways between a Full Patched Member and his Associate, the rights of both the Full Patched Member and the Associate will be respected equally by the Club. The Associate will be expected to leave the Club without risk to the Membership status of the Full Patched Member. If the Associate wishes to remain with the Club, an appeal will be made to the Club’s leadership (first to the Chapter Leadership, and then to the International Executive Board, only if she is unsatisfied with the results of their appeal to the Chapter Leadership). Such appeals will be handled on a case-by-case basis.

 

XV. TERMINATION OF MEMBERSHIP
15.01 Annual Membership Review
Mayhem MC will review Membership status yearly on the basis of participation, behavior, continuing background checks, and overall dedication to the Club and its mission. If a Member is found to be in bad standing, the Mayhem MC will decide if that Member shall be counseled, suspended, or terminated. The President for the territory in which the individual holds Membership will be notified and may also be involved in counseling.


15.02 Dismissal Procedures
Membership of any Mayhem MC Member shall be terminated if that Member has submitted a written request for dismissal to the President and/or Vice President of his Chapter. The President and/or Vice President shall respond in writing to that request with permission of dismissal. Upon dismissal of a Member, all Mayhem MC Colors (and any other material or digital Club property) will be returned to the Chapter immediately. Mayhem MC. Former Members and non-Members are prohibited from wearing Mayhem MC Colors unless in a supporter capacity, per the discretion of the Club. (Any and all disagreements will be brought to a vote.)


15.03 Conduct Unbecoming of a Patch Holder
Termination can occur if any Member is found to have engaged in activities (online, in public, or within his family) that are unbecoming of a Patch Holder and reflect poorly on the Club as a whole, as defined in the Codes of Conduct. Any Chapter President has the right to call a motion to have a Member suspended or voted out for conduct unbecoming of a Patch Holder. Once evidence is gathered and presented to all Chapter Members, a vote will be held. No decisions for termination will be made unless a majority vote can be reached. If the Member is voted out, he or she must immediately turn in the Mayhem MC Colors to a current Member in good standing, relinquish control of any digital information (Facebook account, email account, or otherwise), and relinquish control of any other Mayhem MC property (bank account, trademark, etc). Any removed Member found in violation of the above requests after being excommunicated from the Mayhem MC will be subject to litigation.


15.04 Violation of Bylaws
If a Patch Holder has violated the Bylaws and/or Code of Conduct to the degree that the violation has become known at the International level, the President’s Roundtable will discuss the issue and propose a plan for dealing with the violation; that proposal will be communicated to the Chapter President. The Chapter will have the opportunity to deal with the offending Member. If the violations continue, or if the Chapter President is unwilling or unable to deal with the violation, the vote will be opened to the President’s Roundtable, which will determine any punitive measures that might be taken against a Member or a Chapter. (The President of that Chapter will have the opportunity to defend his actions, the Chapter’s actions, and his Members’ actions at the Roundtable meeting.)

 

XVI. CONDITIONS FOR SUSPENSION OR TERMINATION
16.01 Club Integrity
The attitude of each Member (full, Prospect or Associate) shall maintain a positive level of enthusiasm for the Club’s mission and accomplishments. Creating animosity and/or consistently displaying a negative attitude toward Club business shall be identified as harmful to the Club’s integrity, and shall be dealt with accordingly.


16.02 Chain of Command
All Mayhem MC Members are expected to respect the chain of command established in the Mayhem MC Constitution and By-laws. The chain of command is as follows: Prospect Members may defer to their sponsors; Associates defer to the Full Patch Member to whom they are associated; Full Members defer to the Executive Board of their own Chapters. Chapter E-Boards defer to the President’s Roundtable. Nomads defer to the International Executive Board. No Mayhem MC Member or Associate may make changes to Club operations, documents, patches, intellectual property, or announce any Club decisions outside of these provisions. Failure to commit to this chain of command may result in a formal inquiry.


16.03 Failure to Pay Dues
Failure to pay dues will result in an inquiry. If a Member is unable to pay dues due to reasons deemed acceptable by the appropriate Executive Board, arrangements can be made to meet necessary dues. Dues not paid for a succession of 90 days will result in suspension of Mayhem MC Colors until dues can be brought current. Dues left delinquent for a 6 month period will result in Membership termination.


16.04 Criminal Charges
Any Member charged with a criminal matter shall be suspended immediately until the matter is adjudicated, or shall be dealt with by the Chapter E-Board or Presidents’ Roundtable, according to the severity of the circumstances. The Presidents’ Roundtable will have final jurisdiction over the proper handling of a Member charged with a criminal offense.


16.05 Written Notification
A Member who has been suspended for any reason shall be notified by the Chapter President/Vice-President.


16.06 Suspension or Termination Procedures
If any suspension leads to termination, that termination shall be voted upon during a scheduled meeting by all attending Full Patch Members (or in cases of extreme urgency or flagrant violation of by-laws, by all E-Board Members). Each Member will be notified of the situation, and a vote will be held. If a Member cannot attend the scheduled meeting, that Member shall forward his or her vote to the Chapter President/Vice-President, or abstain from the vote entirely. Majority vote will determine whether the Member in question is to be terminated, or whether full Membership rights can be regained. The same will hold true if the vote is rendered by all Board Members rather than the Members of the Chapter. This instance could occur if several Members from one Chapter were in violation of the by-laws, and a majority vote could be reached within the Chapter. If the majority of a Chapter is in violation of the Bylaws, the issue will be presented to the President’s Roundtable, and a majority decision will determine any punitive measures taken against the Chapter.


16.07 Disciplinary Action
Disciplinary action toward any Member for violation of the Mayhem MC Constitution and By-laws will be dealt with on a case-by-case basis, and all circumstances surrounding the issue shall be considered. Disciplinary action may include, but is not limited to: verbal reprimand, written reprimand, probation, suspension, or termination. Disciplinary action of any kind shall be documented and included in that Member’s file for future review. Any issues and/or concerns that do not result in disciplinary actions, but have in some form disrupted the mission of the Mayhem MC, will also be included in the Member’s file for future review. That file shall be maintained by the Chapter Secretary, and hosted on the Mayhem MC Cloud Drive and granted visibility to the Presidents’ Round Table.


16.08 Membership Reinstatement
A suspended Member who wishes to be reinstated must submit a written request to their Chapter President/Vice-President. If the suspension resulted in dues or monies owed, that debt shall be paid in full before reinstatement in the Mayhem MC. If the Member is unsatisfied with the response he has received from the Chapter E-Board, he may forward his request to the Presidents’ Roundtable.


16.09 Formal Hearing Requests
Any Member who has been subjected to suspension or termination has the ability to request a formal hearing with the Mayhem MC. The hearing will be presided over by the Member’s Chapter E-Board and any other Chapter Members. This hearing shall be the suspended or terminated Member’s opportunity to make a case for him or herself for immediate reinstatement into the Club. Upon completion of the discussion, the subject in question shall remove himself or herself from the room. The attending Members must approve the actions taken by the E-Board with a majority vote. If the attending Members do not support the actions taken by the Mayhem MC, then the subject in question shall be immediately reinstated with full privileges. Should the Chapter E-Board become unsatisfied with the Chapter’s majority vote, the issue may be brought to the Presidents’ Roundtable, and the vote may be opened Club-wide.


16.10 Right to Revoke Membership
Mayhem MC reserves the right to decline an application or revoke a Membership at any time for any reason.

 

XVII. DISCLAIMER
17.01 Disclaimer

Membership with the Mayhem MC is voluntary. As such, the Mayhem MC shall not be held responsible for any acts of God, negligence, Members, or other motorists, that result in injury or death.

GENERAL RULES

Mayhem M.C. is a motorcycle club . President, Vice President,sgt at arms, Secretary, and Treasurer are all elected officers, along with two additional elected members,tailgunner, road captain, who are not club officers for the Executive Board. All others appointed by the President with a confidence vote from patch-holders in good standing is required.

 


PRESIDENT

The executive duties of the president are as follows:


1. To preside over meetings of both the Executive Board and the club as a whole.

2. To judge items not covered in the constitution or in the rules regulations.

3. Directorship gives the president authority to judge items not in the constitution.

4. To act as the personal representative of the club in the area of public relations; as a liaison between the DBMC and local-law enforcement agencies; and as a connecting link between the DBMC and other outlaw motorcycle clubs.

5. To represent the club in any club business contacts and to supervise major economic transactions.

6. To assist Mayhem officers in the interpretation of their club responsibilities, and to promote club life among members in general.

7.the president is not a voted in position,current president will be president for life.

VICE-PRESIDENT

The executive duties of the vice president are to assume the responsibilities of the presidency when the president is unable to do so.


SECRETARY

The executive duties of the secretary are as follows:

1. To record and safeguard the minutes of the club meetings.

2. To maintain the Club Constitution, recording any additions, deletions, or modifications.

3. To handle any club correspondence.


TREASURER

The executive duties of the treasurer are as follows:

1. To monitor and record the club's income and expenditures.

2. To collect the dues and fines owing by members.


EXECUTIVE BOARD

The executive board consists of those members who were elected as officers of the club along with two additional elected members who are not club officers. The board holds scheduled meetings every two weeks. Emergency meetings can be called if a situation arises that demands immediate attention. The executive board is responsible for:

1. The monitoring of conflicts within the club.

2. The application of disciplinary procedures.

3. The evaluation of prospects and their progress.

4. The presentation of summarized assessments of the overall club situation to the membership (court).


ROAD CAPTAIN

The executive duties of the road captain are as follows:

1. To plan the travel routes and organize the basic itinerary of the club prior to going on a 'run' (tour).

2. To lead the club in formation while riding on tour.

3. To enforce club rules and procedures for group riding.

4. Designate a maintenance supervisor for all club vehicles.


SERGEANT AT ARMS

The executive duties of the sergeant at arms are as follows:

1. To maintain order at club meetings in particular, and club activities in general.

2. To ensure that members adhere to club rulings, policies, and expected models of conduct when dealing with other members or outsiders.

3. To defend club members, property, or territory from outside threats.

4. sgt at arms is bodyguard for club president

COURT

Court will consist of all patch holders that are eligible to vote.


ELECTIONS OF OFFICERS AND EXECUTIVE BOARD NON OFFICER MEMBERS

Officers of the club serve a twelve-month term of office, annual elections are held at the last regular meeting of the year, in December.

1. In order to be eligible for office, a patch holder has to have been an active member in good standing for a minimum of one year.

2. Patch holders who aspire towards a particular position will campaign informally for one month prior to the elections.

3. Electioneering is conducted on an interpersonal face to face basis.

4. Hopeful candidate will approach a member, inform them what he is willing to stand for office if nominated, ask for member's opinion of his qualifications, and solicit the member's support.


Meetings

1. One organized meeting per month.

2. Majority rules.

3. If a vote is taken at a meeting and a member is not there, his vote is void.

4. Meetings will be closed except for prospective members and anyone there on business.

5. All meetings will be run on a parliamentary basis. Members will be evicted for unruly conduct.

6. Quorum for a meeting is sixty percent of membership and eighty percent for membership votes.

7. Everyone will attend the meeting on his bike if it is favorable weather, unless his bike is broken down or not running at the time. If the club calls a ride/meeting, all members will attend. If a member is working, sick, bike not running, he will be excused.

However, if a Devils Breed repeatedly uses work as an excuse for not 'being there,' he will be 'talked to'.

8. Members must have colors with him when attending meetings.

9. Members must be of sound mine (straight) when attending meetings.

10. If a member attends a meeting and is fouled-up, he will be FINED.

11. There will be absolutely no booze or drugs consumed during meetings.

12. During a meeting there will be no talking among members until they get the floor through the president. A sergeant-at-arms, if not present, will be appointed and anyone not abiding by the above will be evicted.

13. Miss three (3) meetings in a row and you're out of the club.

14. Anyone missing meetings even if at work gets fined $50.00 except for guys in hospital or jail or out of town for a period of time, including prospects.

15. Members must attend meetings to leave club and turn in his colors and everything that has the name Mayhem MC on it (T-shirts, wrist bands, mugs, etc.).

 

Membership qualifications/ Prospects

1. Prospects must be at least 18 years old.

2. Prospects must have a reliable motorcycle.

3. Prospects cannot do any drugs.

4. Prospects must show a sincere interest in club and bikes.

5. Prospects on the road with bike equipped for the road.

6. Prospect must be sponsored by one member who has known him at least one year (may be waived by vote).

7. Sponsor is responsible for prospect.

8. Sponsor can pull a prospect's rockers at his discretion.

9. Prospects must attend all meetings and club functions.

10. Prospects must do anything another member tells him to do, that a member has done or would be willing to do himself.

11. Prospect will stand behind club and members.

12. No stealing from prospects.

13. Prospect must ride his bike to meeting at time of being voted into club.

 

15. Prospect members must be voted in. Two 'no' votes equal a rejection. One 'no' vote must be explained.

16. Prospective member's prospecting period is at the discretion of sponsor and the club. Directorship shall decide when vote is necessary.

17. Every patch holder in mayhem must vote for prospect to make center patch. Vote must be unanimous.

 

19. Only the sponsor or an officer may hand out a patch to a prospect. This will be done at a meeting with only patch holders present.


RULES AND REGULATIONS

The rules of the club will be strictly enforced. If anyone breaks them, executive board will deal them with. If these rules and regulations are broken, it could mean either immediate dismissal or suspension, whatever the executive board sees fit.

Breaking any of the following Rules will be reason for immediately kick-out from club and probably an Ass Kicking:

1. Failure to pay his dues according to the section dealing with the paying of dues.

6. There will be no stealing among members. Anyone caught will get an ass kicking and be kicked out of the club (Automatic kick-out from club).

7. If a patch holder or prospect throws his colors or quits, colors are pulled (Automatic kick-out from club).

8. Members cannot belong to any other clubs.

9. If a group or individual attacks any member, the whole club shall stand behind him and fight if necessary. If, however, the member is drunk and aggressive and purposely starts an argument, the rest of the members will escort him away, or step between before trouble starts.

 

11. No member will destroy club property purposely.

12. No member will take the attitude that he doesn't have to help other members and other members don't have to help him

13. No member will go against anything the club has voted for and passed.

14. No member will get together on their own and plan something for themselves on club rides. It will be brought up to the whole club and the whole club will participate in anything that is decided upon.

15. The club will always stay together on rides, runs, parties, field meets etc. and will not fraternize with club's rival clubs. The only way a member will be permitted to leave the main group will be to notify the president or whoever is in charge. When the time comes that the majority feels it is time to leave, we will all leave together. Anyone staying behind for a good reason will do so at his own risk and can expect no help.

16. Members will have good attendance. Members must have a good reason for not attending meetings or rides, such as working, sickness, no transportation, and bike not running.

 

General Rules

If anyone breaks general rules, executive board will deal with them and/or voted by the court.

 

 

3. If you don't help out the Club in its activities and you use the Club solely for your benefit, you will be warned. No second chance.

5. Mayhem members losing privilege of wearing colors will also lose privilege of voting and ruling over prospects.

6. The treasurer shall keep a clear record of all money paid in and out during the week and will balance it before every meeting; the books will be gone over once a week.

 

 

 

10. Where we go on our rides will be voted upon by the entire membership.

11. Each patch holder/prospect is required to maintain a valid motor vehicle license, which includes the authorization to operate motorcycle.

 

 

 

15. Confirmation vote is required for all new patch-holders at their 12-month point. Unanimous vote from all good standing members is required.

16. Absolutely no talking about Club business to persons outside the Club.

 

18. If the Road Captain or an Officer determines your bike is unsafe to ride, you are grounded until it is safe.

 

 

 

22. There shall be a wrecking crew consisting of the Sergeant at Arms, the Junior Patch, and whomever the Senior Patch may designate. The purpose of the wrecking crew is to check out bars, etc. prior to entry by President, Vice President, or Senior Patch.

23. Prospect will watch all bikes when members are at Club functions, in bars, and anywhere the senior member present deems necessary.

24. There will be a Club run on a Sunday once a month. Whoever picks the run route will lead the pack.


DUES/LOANS

1. Club dues will be paid each month, due at or by the monthly meeting,.

2. Two months overdue is the limit.

3. dues are $50.00 per month and $100.00 yearly.

 

5. Annual Dues of $100.00 will be paid at monthly meeting in October.

6. Upon failure of paying dues within two weeks, member shall be suspended and turn in his colors.

7. If within two months dues still aren't paid, the colors will be forfeited to pay them and member will no longer be considered a member. The only exception to this shall be if a member is in jail or if he is out of town for a period of time. If he is in jail, dues won't be expected, but if he is out of town dues will be paid when he returns.

 


Respect

1. Respect is to be shown to all club members, officers, members, members', bikes, OL', ladies, house, job, etc. In other words, if it's not yours, 'Don't Mess with it.

2. Respect your colors.

3. No stealing from members.

4. No fighting among each other is allowed, any punches to be thrown will be done by the Sgt At Arms.


Colors

1. President gets colors when new member is voted in.

2. When a member leaves club, member turns over colors to president of chapter.

3. Respect your colors; don't let anyone take them from you except the president of the chapter.

4. No colors are worn in a cage, except during funerals and loading or unloading a bike from a truck.or when on club business.

 

6. Nothing will be worn on the back of your jacket except colors.

7. Colors must be worn at all times when riding or at Club functions. Only one of your brothers or your OL' lady can babysit your colors. Colors are not required to be worn to and from employment if not allowed by employer. If patch is lost or stolen, patch holder will be judged by court.

8. The only way a member of Mayhem mc can retire and keep his patch is if local officers authorize him. Minimum time for retirement is 5 years.


OL' ladies

1. Don't fuck around with brother's OL' lady. (Probably an Ass Kicking and kick-out from club).

 

3. Members are responsible for their OL' ladies.
